Welcome to Incoplace, a local community forum operated by a small independent team (the "operator", "we", "us", "our"). Incoplace is a small-scale, best-effort service without guaranteed service levels, and these Terms should be read with that in mind. By accessing, registering for, or using this website (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not access or use the Service.
You must be at least 18 years old to register an account. By registering you confirm that you meet this requirement and that you are able to form a legally binding agreement with us. We may suspend or remove any account that we believe does not meet this requirement. Any member may report an account they believe is underage using the "Report" option on that member's profile; accounts removed on age grounds keep their email address and username reserved (so the account cannot simply be re-created) and may appeal the decision by contacting us.
The games section may be played by visitors of any age without an account, using a free Game Pass (an email-verified, games-only identity). A Game Pass grants no access to the community forum, messaging, or any other feature, and the Site Rules apply to conduct in game rooms — including the nicknames players choose. We may revoke a Game Pass at any time.

The Site Rules and Community Rules are incorporated into, and form part of, these Terms by this reference. By posting, commenting, messaging, or otherwise participating anywhere on the Service, you agree to comply with these Terms, the Site Rules, and the Community Rules that apply to that area. Where Community Rules for a specific forum or category are stricter than the general Site Rules, the stricter rules apply within that area. A breach of any Site Rule or Community Rule is a breach of these Terms, and may result in removal of content, warnings, or suspension or termination of your account. It is your responsibility to review the rules that apply to each area before participating in it.
Rules posted anywhere on the Service are binding. Rules, guidelines, requirements, or directions issued by the operator or by site administrators anywhere on the Service — including in pinned or designated rules threads, posts, category descriptions, announcements, or notices — form part of the Site Rules or the Community Rules for the relevant area (as applicable), are incorporated into these Terms, and are binding on you from the time they are posted, whether or not you have read them.
When posting content, sending messages, or otherwise participating on Incoplace, you agree not to:
You retain ownership of content you post ("Your Content"). However, by posting Your Content on Incoplace you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable, and (to the extent permitted by law) irrevocable licence to host, store, use, reproduce, modify (for formatting and display), adapt, publish, distribute, and display Your Content as part of operating, promoting, and improving the Service. This licence continues even after you stop using the Service to the extent required for our legitimate operational, legal, and backup purposes.
You represent and warrant that you own or have all necessary rights to Your Content and that Your Content does not violate these Terms or any law or third-party right. Because you alone are responsible for Your Content, you may expose yourself to liability if you post content without the necessary rights.
We do not pre-screen user content and are not responsible for content posted by users. However, we reserve the right (but have no obligation) to remove, hide, or refuse any content that violates these Terms or that we deem inappropriate, at our sole discretion and without notice.
Incoplace operates a volunteer moderation team. Moderators may remove posts, issue warnings, or ban accounts that breach these Terms, the Site Rules, or the Community Rules. Moderation is voluntary and we are not responsible for the actions, inaction, or decisions of moderators. Moderation decisions may be appealed by contacting us, but we retain final authority over all decisions. We may also temporarily restrict site features for all or some users — for example pausing image uploads, new logins, registrations, messaging, or applying posting rate limits — where we consider it necessary for the stability, security, or safety of the Service.
Users may request promoted listings ("posters") through the site. All submissions are reviewed before going live, and you agree to advertise only lawful goods and services. Prices shown during submission are estimates; final pricing is confirmed with you before any payment is taken, and payment is arranged directly with us — no payment details are collected through the site. Advertising slots are limited per area and time period; submission does not guarantee placement, and waitlisted submissions run only if a slot becomes available.
We may reject any submission, and may remove a live advertisement, at our discretion. Where removal is due to a violation of these Terms, the Site Rules, or applicable law, no refund is payable. Otherwise, if we remove a paid advertisement before the end of its paid period for reasons not attributable to you, our liability is limited to a pro-rata refund of the unused period, and nothing in this section limits rights you have under the Australian Consumer Law.
All design elements, logos, software, and original content produced by Incoplace are our property and may not be copied, reproduced, or distributed without written permission. The Incoplace name and branding are not to be used without authorisation.
We respect the intellectual property of others. If you believe content on the Service infringes your copyright or other intellectual property rights, please contact us through the site with: a description of the work, the location (URL) of the allegedly infringing content, your contact details, and a statement that you have a good-faith belief the use is not authorised. Notices are reviewed in good faith as time permits; we may remove content and, in appropriate cases, terminate accounts of repeat infringers, but no particular outcome or timeframe is promised.
Incoplace is a community platform. We do not vet, verify, or vouch for users, their identities, their content, their listings, or anything they offer, buy, sell, or arrange. Any interaction, communication, arrangement, or transaction between you and another user — whether online, by message, or in person — is solely between those users and is undertaken at your own risk.
Incoplace is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, secure, or free of harmful components, that any content is accurate or reliable, or that information stored on or transmitted through the Service will remain secure, confidential, or intact. Use of the site is at your own risk.
To the fullest extent permitted by law, Incoplace and the operator (and our respective agents, contributors, moderators, and service providers) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of goodwill, or business interruption, arising out of or in connection with your use of (or inability to use) the Service or these Terms, even if advised of the possibility of such damages.
To the fullest extent permitted by law, we shall not be liable for any damages, losses, or harm arising from or in connection with: (a) content posted by users or third parties; (b) the conduct of, or any dealing or dispute with, any other user; (c) unauthorised access to, alteration of, or disclosure of your data or account; (d) security incidents, cyberattacks, or data breaches affecting the site or its infrastructure; (e) the acts or omissions of third-party service providers used to operate the site; or (f) any modification, suspension, or discontinuation of the Service.
To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of (i) the total amount you paid us (if any) in the six months before the event giving rise to the claim, or (ii) one hundred Australian dollars (A$100).
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for breach of such a guarantee cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Incoplace and the operator (and our respective agents, contributors, moderators, and service providers) from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) made by any third party or arising out of or connected with: (a) your use of or access to the Service; (b) Your Content; (c) your breach of these Terms, the Site Rules, or the Community Rules; (d) your violation of any law or of any rights of another person or entity; or (e) any dealing, transaction, or dispute between you and another user. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

Acknowledgment — small-scale service. You acknowledge and agree that Incoplace is a small community website operated on a best-effort basis, without the security teams, infrastructure, or resources of large commercial platforms, and that you take this into account in deciding what information to submit. You agree not to submit to the Service — whether publicly, in private messages, or in your profile — personal, sensitive, financial, or confidential information (your own or anyone else's) that you are not prepared to have disclosed. Any information you choose to submit is submitted at your sole risk.
We will not intentionally disclose your personal information except as described in the Privacy Policy or as required by law. However, no assurance is given that information held by the Service cannot be accessed, lost, corrupted, or disclosed through error, fault, or events beyond our control, and to the fullest extent permitted by law we accept no responsibility or liability for any such access, loss, corruption, or disclosure. Nothing in this section excludes rights that cannot lawfully be excluded.
When you register, you may provide an email address, which is used for account verification and account communications (such as password resets). Email addresses are not displayed publicly on the site, are accessible only to site administrators for account management, security, and support purposes (moderators do not have access), and will not be sold to third parties.
You may terminate these Terms at any time by deleting your account and discontinuing use of the Service. To the fullest extent permitted by law, we may suspend or terminate your access to the Service, or your account, at any time and for any reason, including for a breach of these Terms, the Site Rules, or the Community Rules. The following sections survive any termination: 5 (User-Generated Content), 8 (Intellectual Property), 10 (Dealings Between Users; Assumption of Risk), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), 18 (Governing Law), and 19 (Miscellaneous).
We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated Terms. We will indicate the date of the latest revision at the top of this page.
If you have an issue or dispute, you agree to first raise it with us and try to resolve it informally by contacting us through the site. These Terms are governed by the laws of Australia. Subject to the informal resolution step above, any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
These Terms, together with the Privacy Policy, the Site Rules, and the Community Rules, constitute the entire agreement between you and us regarding your use of the Service. Our failure to enforce any provision is not a waiver of it.
