Incoplace is a community forum operated by a small independent team (the "operator", "we", "us"). This page describes, for transparency, what information the Service handles and how it is used. It is a description of current practice only — it does not constitute a contract, a warranty, or a representation of compliance with any particular law or standard.
As a small-scale operation, Incoplace generally falls below the threshold at which the Australian Privacy Act 1988 (Cth) applies. We endeavour to act consistently with the general spirit of the Australian Privacy Principles as a matter of good practice; however, strict compliance with the Privacy Act, the GDPR, or any other privacy regime is not claimed and should not be assumed. The Service is directed at users in Australia; users accessing it from other jurisdictions do so on that understanding.
This page should be read together with the Terms and Conditions, including the limitations of liability set out there, which apply equally to the matters described on this page.
The Service does not respond to browser "Do Not Track" signals.
Information is used to operate the Service: authenticating you, displaying content relevant to your selected location, sending account emails (verification, password reset, and a weekly community digest which includes a summary of any unread notifications — the digest can be disabled in your settings, and every digest carries a one-click unsubscribe link), preventing spam and abuse, and understanding overall usage through aggregate figures. The Service does not send marketing emails, and personal information is not sold or rented to any party.
Like most websites, Incoplace operates on third-party infrastructure, and data is stored on or passes through the systems of those providers:
Certain providers are located overseas (principally the United States and the European Union), and data is accordingly stored and processed outside Australia. Beyond these providers, information is disclosed only where required by law, where genuinely necessary to protect the Service or its users, or in connection with any sale or transfer of the Service, in which case data would transfer with it.
Posts, replies, and images submitted to Incoplace are publicly visible, together with your username and selected location, and may be indexed by search engines. Do not post material publicly that you wish to keep private. Private messages are visible to the participants in the conversation, and to the operator where a message is reported or where review is necessary for security, legal, or support reasons.
Information is retained for as long as it remains useful for operating the Service; no fixed retention periods are promised. Account data is retained while the account exists. Logs and security data are cleared periodically. Images are delivered through content-delivery caches, and a deleted image may persist in such caches for a period before expiring. Upon account deletion, profile details are removed and posts are anonymised (see section 8); copies may nonetheless persist in backups and caches for a period thereafter.
Reasonable precautions are taken, including password hashing, HTTPS, and standard protections against common classes of attack. However, Incoplace is a small-scale service, and no guarantee of security is given; you use the Service at your own risk. To the fullest extent permitted by law, the operator is not liable for unauthorised access to or disclosure of information. In the event of a serious breach, we will take the steps actually required by applicable law of a service of this nature at the relevant time, and will otherwise act in good faith as reasonably practicable. Nothing on this page excludes rights that cannot lawfully be excluded, including under the Australian Consumer Law. By using the Service you accept these limits, and you agree not to submit information — publicly or privately — that you are not prepared to have disclosed.
The following tools are provided as features of the Service. They are offered voluntarily and their provision is not an admission that any particular law requires them:
Requests beyond these tools may be submitted through the Service and will be considered in good faith. Identity verification may be required, and no particular outcome or timeframe is promised.
Concerns about the handling of your information should be raised through the Service in the first instance; most matters can be resolved directly. The Office of the Australian Information Commissioner (oaic.gov.au) is the national privacy regulator, noting that, as set out above, the Privacy Act may not apply to a service of this scale.
Incoplace's community features are intended for adults. You must be 18 years or older to register a forum account, which is stricter than the minimum age of 16 set by Australia's social media minimum age law. The community forum does not knowingly collect information from anyone under 18.
The standalone games section is an online gaming feature that can be played by visitors of any age without a forum account, using a Game Pass (see section 1). A Game Pass provides no access to the community forum, messaging, profiles, or any other social feature — only the games.
Age requirements are enforced through layered measures: an age declaration at sign-up; a dedicated "underage account" option when reporting a user, which any member can use to flag an account they believe belongs to someone under 18; moderator review of those reports and of age signals encountered during ordinary moderation; and removal of accounts assessed as underage. A removed account's email address and username remain claimed so the account cannot simply be re-created, and removals can be appealed through the contact channel below if made in error.
This page may be amended at any time. The date of the most recent revision appears at the top. Where a material change is made, reasonable efforts may be made to notify users through the Service. Continued use of the Service after a change constitutes acceptance of the current version.
